Qleave Undertakes Program To Enhance Portable Long Service Leave Service For Industry

 

QLeave is undertaking a program of work connected to providing an equitable and efficient system of portable long service leave for eligible workers in the building and construction industry (otherwise known as Remediation). The program includes consideration of historical decisions, policies, procedures and systems.

I’ve heard QLeave is undertaking a work program that may impact current registered workers, employers and levy payers – is this correct?

QLeave, with the support of the Building and Construction Industry (Portable Long Service Leave) Board, is taking steps to enhance its operations, including decision making within the organisation. As part of this, QLeave has identified some examples where past decisions may not have met good decision making practices. To address this, QLeave has commenced a program of work to understand any potential impact on workers, employers and levy payers and to ensure that their human rights are considered.

What are the immediate priorities for this program?

From 1 July 2023, the QLeave program will take steps to enhance:

  • the manner in which QLeave communicates with registered workers, employers and levy payers
  • the application of worker service credits
  • eligibility of safety officers
  • assessment of human rights

I carry out work as a safety officer. Do I need to contact QLeave to discuss my long service leave?

QLeave will engage directly with you if necessary to discuss your eligibility for the portable long service leave scheme. You can contact QLeave on 1300 753 283 if you have any questions.

Can I accrue service credits when I am on long service leave?

No. Under the Building and Construction Industry (Portable Long Service Leave) Act 1991 long service leave entitlements are calculated having regard to service credit. While an eligible worker is receiving paid long service leave from QLeave, they are not entitled to accrue service credits for those same days.

The last time I took long service leave with QLeave, I accrued service credits. What happens to these service credits now?

QLeave will not remove any service credits from your record that you accrued during periods of long service leave taken before 1 July 2023.

Will the program affect my ability to lodge my worker service return?

No – if you’re an employer you’re still required to lodge a certificate of service for all your eligible workers in accordance with the Building and Construction Industry (Portable Long Service Leave) Act 1991.
